INTRODUCTION.
The edict/law was enacted in 1985 and came in to force on 1st day of february ,1985. It is divided in to four 4 part of a total of 18 sections and a number of subsections.it seek to regulate islamic preacing by licencing preachers,limiting the subject ,the and area of their preaching,keeping a comprehencive data of all person licences to preach ,monitoring the movement and activities of evert licenced islamic preacher and punishing any persons who preaches any islamic injucttions without preaching permit pr having been licensed, breaches any restriction contained on the face of shis permit the law or any order that may be subsequently made by the Governor of the state
MAJOR PROVISIONS OF THE LAW.
Part I (commencement and interpretation).
This part provides for the date the law would come into effect (which is the 1st of fabruary,1985 and defines the major terms/ words/ phrases used in the law the most important of such terms is the phrase public which was defined to mean any highway bublic park gården, river bank,public bridge, road lane foot way pathway, spuare, court, alley, passage any open space,building or structure to which the pubulic have or are permitted to have access.
Part II
(Religious committee (s)and sub-committees).
This part establisshes a committee to be known as committee for islamic Religious preaching and a sub committee to be known as sub committee for islamic Religious preaching committee for islamic Religious preaching This committee is to be established in every emirate council (Note that This Edict was promulgate at a time when there were four (4) Emirate council in kano state.so there will be only one committee as we have only one emirate council as at now).the Governor may establish any other committee or committees in respect any Religious denomination or organization to regulate the activities of members of that denomination or organization.
COMPOSITION OF THE COMMITTEE .
This committee shall be composed of a cchairiman and not less than six (6)members all of whom are to be appointed by the Governor in consultation with the E emirate council concerned. Members of the committee shall hold office for a period of three (3)years which may be renewed indefinitely but a member mey resign or be removed by the Governor before the expiration of his tenure. The secretary to the Emirate council shall serve as secretary to the committee.
FUNCTION OF THE COMMITTEE
The committee shall perform the following functions.
A). To receive applicatios for preaching permit from any person wishing to preach in any local Governmint area in the state.
B) Qualify or diaqualify such å person
C)Grant permit to those qualified,.
D). Establish and standards for exmination and qualification Religious preachers.
E)open and keep registrer of preachers Li censed to preach in the staten.
F) Do any other necessary for the implementation of the law.
SUB-COMMITTEE FOR ISLAMIC RELIGIONS PREACHING
.This sub-committee is to be established in every local governmernt area of the state.
COMPOSITINON OF THE SUB-COMMITTEE
Å) the chief Executive officer of the local Governmernt.
B)All distict heads in the local Governmernt.
C) The DPO in charge of the local Governmernt .
D) The chief lmm in the headqaurters of the local Governmernt .
E) The EO in charge of islamic Education
F)Social welfare officer in charge of the local Governmernt .
G) Tow other members to be appointed by the commissioner for local Governmernt.
Affairs in consultation with the committee and shall hold office for å period of three(3)
Years which may be renewed indefinitely but a member may resign or be removed by
The commissioner before the expiration of his tenure.
H) the secretary to the local Governmernt shall the secretary of This committee.
FUNCTIONS OF THE SUB-COMMITTEE
the sub-committee shall perform the following functions.
A) receive applications from applicants in the local governmernt.
B) forward such applicantions to the committee.
C) monitor the monument and activities of preachers lovende to preach in their local governmernt.
D) keep a register all licensed preachers in the local governmernt.
E) causing the arrest of any person preaching without permit or in violation of any contaions imposed on him.
F) Any other function (s) that may directed by committee.
PART III (PREACHING PERMITS
From the commencement of This law no person shall preach any islamic Religious injunction in without a preaching permit granted to him by the committee.
.Any person wishing to preach may apply for preaching permit by submitting an application in writing to the distict head in charge of area.
.the distict head shall forward the applicantion to the sub-committee.
.on receipt of the applicantion the sub-committee shall forward same to the committee for acton.
.on receipt of the applicantion, the committee may subject the applicant to oral, written or any kind of exmination.
. The committee may grant a preaching to the applicant if it is satisfied that the applicant has the requisirte islamic knownledge and experience, is a musilm suholar of repute and is capable of complying with the conditions that may be attached to his permit,
. The committee may impose conditions or restrictions on the permit of any preacher. Such restriction may include subject matter, period and the town or village the preacher is permitted to preach.
. The permit shall be renewable on the expiration of the period specified on it.
. The committee may
revoke a preaching permit if the holder of the permit violates any condition or restriction contained in the permit or This law,where it is established that the permit was obtained fraudulenrly or is is in the interest of the pubulic to do so.
. A police officer or a member of the sub-committee may order any holder of preaching permit to produce same for inspection and the holder shall comply
. The sub-committee shall monitor the movement and activities of permit holders.
. The committee shall forward the names and particulars of everyone permitted to preach in the state to the council of chiefs and the state security council on or before the 30th day of every year.
. If the committee is satisfied that the applicant is not qualified to preach, it shall refuse him preaching permit.
PART IV ( PUNISHMENT)
. Every person who preaches without a valid preaching permit, violates any conditions placed on him or insults, or seeks to excite contempt of any Religious denomination in manner that is likely to lead to disorder or breach of peace has committed an offence and shall be punished.
A) in respect of a 1st offence with a fine no exceeding N100 or imprisonment for three (3) months.
B) in respect of a
2nd or subsequent offence, with a fine not exceeding N200 or imprisonment for six months.
Note that This section is now in the last stage of its proposed amendment to impose.
A) A fine not of less than N50,000 or imprisonment for a period of two years in respect of a 1st offence.
B) A fine of not less than N100,000 or imprisonment for a period of four years in respect of a cecond or subsequent offence.
OBSERVATIONS
1 this law is discriminatory as it only applies to islamic Religious preachers to the exclusion of the preacher of other faiths .this is a violation section 42 of the constitution guaranteeing right to freedom from discrimination on account of ethnic group sex religion etc.
2. It provides for the censorship of preachers for what they have no yet said while permitting political office holders to say as they wish This is a breach of the right free expression guaranteed under suction 39of the constitution .
3. It provides for monitoring the movement and activities of the islamic preachers as if they were notorious criminal or suspects. The is breach of the right to private and family life guaranteed under section37 of the constitution.
4. It also violates the right the members of the public to receive information, ideas and opinions as it restricts the right of those who give them the informantion, ideas and opinions .
5. Wa,azin maguzawa will be seriously affected if not completly stopped. This is because the law restricts evangelization activities of islamic preachers to their local government only. Other Religious commissioneries are however permited to undertake evangelizatio activities in any part the state without limitations in terms of subject, time, places e.t.c
6. The Does not befine nor Dora it provide any yardstick for the measurement of islamic knowledge, experience and repute required of all applicants. The use of viss and arbitraty use of poser are vert likely,.

it empowers the committee to judge whether an applicant will, in the opinion of the members of the committee comply with the conditions or restriction of the permit
8. It Dora not mandate the committee to grant permit even where an applicant is Qualified as the word may, not shall was used in section 12 of the law
9. It Does not involve musilm scholars who will be the subject of the law
10. It restricts the preaching of any muslims scholar, however knowledgeable he might be, to one local government area only. The law does not provides for dual or multiple permits .
11. It lmplies that no preachers preaching van be skred in any radio or television station in the state, as all radio and retevision station cut across several local governments
12. It empowers pollice officers and sub-committee members to interrupt any preacher or even pubulically embarrass him by sanking him to produce preaching
13. The law does not provide for any procedure to challenge the decision of the committee either by way of appeal to another committee or by way of action in court.
14. The law imppses strict laibility on any person who preaches regardless of the content of his preaching.
15. The law does not provide for a timeframe within which the committee shall decide to qualify or disqualif an applicant. So, an application may lie for a ling period of time without getting consideration, whether favorable or otherwise.

Alhamdulillah wannan kungiya tana da jarin malamai na dukkan mataki da masallatai da makarantu, abinda ya rage mata shine yadda zata rinka samun hanyar gudanar dasu, to Yanzu muna ganin Allah ya kawo lokacin, don wannan tsarin kati yayi nisa, kuma mutane suna bayar da hadin kai yadda ya kamata.
